As a partner of the project, the crew of the TP52 Blue Carbon has been working to become the first carbon-neutral Spanish boat in Mediterranean racing circuits, as well as the leading example of zero-emissions sailing. The goal is to lead a change in the nautical sector and take action on the current environmental situation.

**TERMS AND CONDITIONS**

 

The company agrees to provide services on the specified date and time as per the contract, previously agreed upon by both parties. The company is obliged to fulfill the contract, provided that payments are 100% made in full and on time, as indicated in the payment terms. Given the situation of port, police, customs, or any other type of authority inspections, either at the port or at sea, the company is not responsible for any expenses or fines incurred due to the client’s failure to meet navigation requirements, nor for the time taken by authorities for the inspection. The company has boat insurance covering collisions, fire, and third-party damage. The lessee will be covered as long as they respect and comply with the legal requirements of the contract and do not act negligently. 

 

The CLIENT and their companions commit to not engaging in any illegal acts under Spanish law. Should any such act occur, the CLIENT will be solely responsible to the authorities. The captain has the authority to cancel the tour at any time during the rental if the clients do not behave appropriately, cause damage, or endanger the safety of the group onboard.

 

The consumption of drugs or any narcotics is strictly PROHIBITED. If this occurs, the captain has the right to cancel the charter and immediately return to port without any possibility of reimbursement or claim by the lessee.

 

If, in the carrier's judgment, a passenger's behavior onboard could endanger the vessel or any person or property onboard, or hinder the crew's ability to perform their duties, or if the passenger disregards any crew instructions, threatens, abuses, or insults any crew member, or behaves in a scandalous or otherwise offensive manner toward other passengers, the carrier may take any necessary action to prevent the continuation of such behavior, including disembarking the passenger.

 

The carrier reserves the right to take any civil or criminal legal actions as necessary. For the safety of passengers and crew, and under the Civil Protection Law concerning the right to honor, personal and family privacy, and personal image, it is prohibited to take videos or photos of any crew member or passenger unless they have given their explicit prior consent. Any crew member may request the deletion of images or videos taken without the proper consent. If, due to a passenger's behavior, the captain reasonably decides to divert the vessel to disembark the passenger, the passenger will be liable to pay all associated costs and expenses resulting from the diversion.

 

Consumption of alcoholic beverages is not permitted unless they have been purchased onboard.

 

**Carrier's Right to Deny Transportation to Passengers**  

The carrier reserves the right to deny transportation to a passenger if, in the carrier's judgment:

- It is necessary or advisable for public safety reasons.

- It is necessary or advisable to comply with applicable laws or regulations of the country.

- It is necessary or advisable due to the passenger's conduct, state, age, or mental or physical condition (including being under the influence of alcohol or drugs), and they may pose a reasonable risk or danger to themselves, other passengers, the crew, or property.

- It is necessary or advisable to avoid serious discomfort or inconvenience to other passengers or the crew.

- It is necessary or advisable because the passenger has previously violated the carrier's rules, and the carrier has reason to believe this behavior may recur. This includes instances where the passenger records crew members on video or audio, either onboard or ashore.

- It is necessary or advisable because the passenger refuses to undergo a security check.

- The passenger has presented the carrier with a document (a) allegedly obtained illegally, (b) reported as lost or stolen, or (c) suspected to be false or altered in any way not done by the carrier. In these cases, the carrier reserves the right to retain such documents.

- The passenger has failed to prove that the ticket has been paid in full, a credit card charge has been requested for cancellation, or there is suspicion of fraud.

- The passenger causes damage to port or company property.

 

If, for any of the above reasons, the carrier denies transportation or disembarks the passenger en route, the carrier may cancel the remaining unused portion of the trip. The carrier is not responsible for any indirect damages and will not be liable for any loss, damage, death, or physical injury claimed due to the refusal to transport the passenger.

 

If the passenger exhibits violent, physical, or verbal behavior, the carrier may request the intervention of port security forces.

 

**Restrictions on Transporting Passengers with Illnesses and Infections**  

The carrier will not accept passengers suffering or suspected of suffering from serious infectious diseases that the health authorities have declared as an official alert, such as severe respiratory infections, viral infections, tuberculosis, or pneumonia.

 

- **Pregnant women**: The carrier accepts transporting pregnant women up to the 27th week of pregnancy (inclusive) without requiring a medical certificate. When the trip occurs between the 28th and 35th weeks of pregnancy (inclusive), an original medical certificate confirming fitness to travel must be provided, including the validity period, medical registration number, and doctor’s signature. Women in the 36th week of pregnancy (32nd if multiple and without complications) or beyond will not be permitted to travel.

- **Minors**: The carrier does not provide Unaccompanied Minor (UM) services. Minors under the age of 12 cannot travel without an accompanying adult over the age of 18.

- For safety reasons, infants younger than 7 days old are not permitted onboard.

 

 

Cancel conditions

**CANCELLATION POLICY**

 

1. **Cancellation due to adverse sailing conditions.**  

If the AC organization officially cancels the races due to weather conditions that prevent the competition from taking place and the contracted boats from leaving their moorings (strong winds, heavy rain, hail, lightning storms, etc.), the companies agree to offer the client an alternative day (among those selected for rescheduling by the AC) or a full refund of the amount paid (third-party service cancellation policies, such as F&B, will be respected).

 

2. **Cancellation of races due to adverse competition conditions.**  

If the AC organization officially cancels the races due to a lack of wind or other conditions that prevent the competition from taking place but not the departure of the contracted boats, the companies will offer the client the option to continue enjoying the event. If the client decides not to proceed with the event and does not board, they will be entitled to a 50% refund (third-party service cancellation policies, such as F&B, will be respected).

 

3. **Cancellation of races during the competition.**  

If the AC organization officially cancels the races for any reason (non-weather-related) after the contracted boats have already set sail, the companies will offer the client the option to continue enjoying the event. If the clients choose to return to port, they will not be entitled to any refund.
